As the legal industry grows, there are more articles coming out about the industry and how it operates. Currently, there are many law school review articles about lawsuit funding that touch on a variety of topics concerning the industry. Lawsuit Reform The enemies of lawsuit funding however cite the existence of the industry as an example why there needs to be reform in the law practice industry. The enemies of lawsuit funding talk of litigation abuse and how the economics actually skew the cases for the benefit of the plaintiff lawyers and not the actual plaintiffs. Lawsuit reform is the cause and call to action against plaintiffs and plaintiff lawyers. The reforms being called for by the advocates will lessen the access of plaintiffs to court and will affect how the legal strategy from the plaintiffs will go forward. The frivolous lawsuits the proponents like to bring up they say clogs the courts and prevents justice or other” worthy” cases from being tried in a court of law. The opponents cite those reasons and others for why lawsuit reform will have a negative effect on the court system and society as a whole. Regulation Lawsuit funding is still looked at as a very new industry. Since its development in the late 1990s in the United States, people are slowly learning about the benefits of using such a thing. For years, citizens have complained about how expensive it is to pursue litigation. Lawsuit funding helps alleviate that problem. This industry has grown from a novel idea to a real option, and with that comes the government. The benefits of the industry are not hard to measure. In purely economic and societal terms, federal and state governments are cutting budgets because of the economic recession, and with those cuts, more people are going to be suffering. That means plaintiffs in the pursuit of justice may not be eligible for legal aid. Lawsuit funding provides a way for plaintiffs to obtain justice even when the odds are stacked against them.
