Before we embark on a journey throwing light on the diverse facets of criminal law, let’s define what exactly “criminal law” is? It is the area of law that deals with serious criminal offences that are carried out against society. It is also known as penal law. It has a set of regulations that govern the process of investigating, charging and trying convicts of criminal offences. The fact is well-known that the overall objective is to attain criminal justice in criminal law. The severe criminal offences that are defined in criminal law necessary have subsequent and adequate punishments that are imposed on anyone who violates the penal provisions.
The nature and purpose for putting a criminal law into effect is for the keeping and preservation of peace and order. It is dissimilar from civil law due to the fact that it covers crimes that are committed against the public as a whole. For instance, murder is against a specific individual. Criminal law punishes not only the act of violating the law, but also conspiracies and intentions to do so. There are divergent classifications within this type of law, which are criminal wrongdoings against the person that includes rape or violence, crime against the property, etc.
The key purpose of criminal law is to prevent people from committing crimes and to punish then when they carry out such a crime, this is known as retribution. Incapacitation is another objective of criminal law, which involves keeping a criminal away from law following members of the public who might have a close encounter with a dangerous situation after being in contact with them. Once an accused is in prison, the objective is to recuperate them into law abiding citizens. Those individuals who commit a crime have the right to have a legal representation to protect them and their criminal lawyer might work to get a diminished sentence that have been committed or to try to release the person charged together.
There are numerous attributes that the criminal lawyer has to have. He needs to be able to care about the well-being of the clients. He has to put his soul and heart in every case he is dealing with. He needs to be aware of the fact that he is always trying to work in the best interest of his clients.
