Claiming legal custody of your baby should be the last thing on new parents’ minds. But for the Blairs, a military family from Georgia, obtaining an Atlanta child custody attorney was top priority following the birth of their daughter Makayla last year.

Alicia Blair expected to bring her newborn daughter home to her husband Fred, an army medic stationed in Kuwait, but after an unverified drug test and a urine sample mix-up, the new mother found herself the subject of harsh interrogations from nurses and staff, and was denied access to her child. A urine sample believed to be Alicia’s had tested positive for methaphetamines, and just minutes after her birth, the Department of Children and Family Services threatened to remove Makayla from her family. Fred Blair was forced to place his daughter in the custody of a family member instead of her mother’s arms.

Alicia’s second drug test, and a similar test performed on her daughter, came back clean. Alicia vehemently denies any drug use during her pregnancy, but she still cannot bring Makayla, now nine months old, home. The clinic vowed to contact the Department of Children and Family Services (DCFS) to rectify their mistake, but as of yet have failed to do so, and without their admission, Alicia has to prove that she is drug-free on her own. With the help of Atlanta child custody lawyers, the Blairs have been able to keep Makayla out of family services, but they continue to face an uphill battle against the DCFS.

Harbin Clinic, about an hour outside Atlanta, where Makayla was born, has since apologized for its error, but the family’s ordeal is far from over. Fred and Alicia Blair have been in and out of court for more than eight months since Makayla’s birth, missing milestones and memories as they work with Atlanta family law attorneys to reclaim their daughter.
