The plaintiff has a right to choose their own forum where a suit can be filed in more than one court. The Supreme Court issues an order warranting such a transfer if it’s satisfied that such a transfer would prove suitable for the ends of justice.

On the other hand, under Section 406 of the Code of Criminal Procedure, the Supreme Court has the power to transfer criminal cases and appeals pending before one High Court or a subordinate criminal court to another High Court or subordinate criminal court. The Supreme Court can act under the section only on the application of the Attorney General or the party interested.
