How fair debt collection practices can help you
Written by Safina Jones
Creditors have rules. They set a legal framework as huge amount of money is involved. The creditors first issue a warning to the debtors, offer notice stating the same, but when someone refuses to pay, they take the help of the ‘bad guys’ or debt collectors who handle the situation. A fair debt collection practice should give the debtor a minimum period of 30 days for a reply.
Debts can be of any type – Personal, Business or Household and mortgage loans. The fair debt collection practices and debt collection practices differ from situation to situation. So a debt collector who is an expert in the respective fields will first contact you and then come over for the collection of the debt.
A lot of people say debt collectors are annoying; they call you everytime, everywhere. It is not a regular thing unless the debtor refuses to pay back even after the stipulated period. The debtor should also keep in mind, that it is not his money but someone else’s. Repayment should be made to keep a healthy relationship between the parties and also avoid the entry collectors as fast as possible.
There are various agencies whose principle business is collecting debt. They hire individuals who in turn make contact with the debtors. They can speak to a Power of Attorney in case there is one or an individual or a lawyer who knows the situation of the debtor. The debt collectors keep in touch with them to get the clear picture and help moving forward in their job.
A fair debt collection practice limits a number of activities, such as non usage of false statements, harassments, non usage of foul languages and unfair practices. If an individual finds that these are not followed by a debt collector, he can seek the help of the law which declares a hefty fine or even imprisonment. If you have multiple debts, make sure they collect money by debt collection practices and fair debt collection practices.
