You will need to consult the employ of the agency so that he can perform a design search for your company. This design search will help check if your logo is violating any other registered logo design and if no issues emerged your logo will be given a green signal.

Once it is ensured that your logo is your own and is not taken from somewhere else. You will have to apply to the USPTO office for registered Trademark symbol status of your original logo design. The trademark must include a drawing of your logo to show how it will appear normally on a package.

After its trademarked you will be allowed to use your logo design with ™ sign.

Registering the Trademark ®:

Once the logo design of your company is trademarked, you can register your trademarking design using a ® with your registered trademark symbol. Normally, using a lawyer for this purpose will be a good idea.

One more thing, for registering your logo design you will have to provide a list of products that can use that symbol as the label and other required documents.
