Restrictions For 501c3 Status

501c3 status has multiple advantages, including tax breaks, government assist, decreased stress and more. These advantages greatly outweigh the risks and restrictions that are placed on the non-profits who go via the procedure, but the restrictions still apply. It is important to understand these restrictions so you can keep your 501c3 status with out trouble and remain fully cooperative with the IRS in every way. Simply because, let's face it, the IRS isn't someone you would like to fight in court. Political rallying, business-related activities and numerous causes are all on the restricted list, but why? Political Rallying Board members, directors or workers are not allowed to voice their approval or give funds to a political candidate in the non-profit's name. This is essential simply because rather than working toward a particular charity, the non-profit is giving cash to a candidate that doesn't actually need the services of that charity. This of course doesn't mean that an individual working for the non-profit cannot support a candidate and donate personal funds to his or her candidacy, but it does mean they can't do it in the name with the organization they represent. There have been multiple legal battles fought over this restriction. Business-Related Activities An additional restriction in the 501c3 exemption status is that any unrelated business activities, or business offers which are not related towards the actual chartered purpose of the non-profit, are topic to taxation. This is why reporting business related returns is an annual requirement if the quantity is over $1000, and why non-profits are careful to relate their business to the non-profit's mission in some way to steer clear of this tax. A non-profit by no indicates has to raise money in a business way various from its original purposes, but if it chooses to, it should pay each state and federal taxes on these profits because it is not related to their charity. Causes The fact that there are hundreds of various causes indicates that it would be quite impossible to refuse a 501c3 exempt organization from lobbying from any of them, even inadvertently. The distinction here is that a non-profit organization may indeed provide resources other than cash, volunteers and common support for a different cause, but cannot give much more than a particular percentage of its assets to the trigger. A non-profit becoming an advocate for a great trigger in legislation is their right under the first Amendment, but that correct does not extend to their tax-free monetary assets.
