Selecting A Good Criminal Lawyer

Lawyers form the backbone of our legal system in the country or state. The societies in general are experiencing a sharp rise in crimes and, therefore, the importance of criminal lawyers is increasing. Lawyers have to follow the prevalent legal system in the country. The world today follows mainly three judicial systems, viz the British legal system, American legal system and the Islamic legal system. Countries formerly under the British raj are mostly using the British judicial system, tailored according to the needs of individual states, i.e. countries in South Asia, some parts of Africa, New Zealand, Australia and other East Asian countries. American law is also quite similar to British, America being a colony of Britain in the past. Although, Islamic criminal law is not enforced at the state level, anywhere in the world, barring a few exceptions like Kingdom of Saudi Arabia and former Taliban, led Afghanistan, but is followed by pockets of people living in different Muslim dominated countries.

Accused need guidance by a criminal jurist or a legal advisor. Criminal laws are founded the world over on the universal principle that a criminal offence is against the state and against public. For the safety of society, crimes must be handled with an iron hand but accused must be afforded an opportunity to be heard. It is here that the role of a criminal legal advisor comes in.

Like other groups of workers, lawyers work in markets, generally located near city courts. Experienced lawyers, however, have joined together to make law firms and law consortiums and share the common knowledge. Mostly they listen the case and take up the cases depending upon the right or wrong and ask for rewards accordingly. Criminal law experts offer services like payments on acquittal and such other terms. Every country keeps their criminals law in a codified format and do not allow unwritten laws. Any crime, which is not documented or codified, cannot be applied to any criminal case, and the offender is most often acquitted on such grounds. There are other provisions in law, which give amnesty to the offenders, and lawyers often try to make use of them. Usually people of unsound mind cannot be convicted. Such people are mostly not even charged.

As a common rule, an offence caused by forced intoxication is also not charged provided the offence has been done unintentionally and under the influence of intoxication. A criminal lawyer must be experienced enough and should guide you about the relevant laws and relevant clauses. Important point to remember is that a criminal offence can never be punished retrospectively. A criminal codified law must always be in force under which the accused is being tried. During criminal proceedings, burden of proof lies on the prosecution and not on the accused. An accused is always considered free of any charge until convicted and the charge proved against him. A slight immoral activity by a lawyer can cause damage to society, and he must be an honest person doing, only the right cases.
