Understanding Labour Law Dubai
Written by James Berry
Abu Dhabi has a system of federal governance as per which states can prefer to either join it or maintain their own independent judicial system. Dubai has opted for the latter. Practicing lawyers in Dubai are needed to have a license to practice law within the federal courts of the nation. It is also essential that lawyers in Dubai should have graduated from either a reputed law or Shariah College.
The recent world economic crisis had its effect on the legal system in Dubai too. While several people claim that the employment situation remained unaffected to a great extent by it, there are many alterations in the labour law Dubai as part of the process of recovery.
The labour law Dubai is governed by a set of cabinet decisions and other regulations. Since 2006, when the Government of Dubai presented the Human Resource Law for its employees, issues such as code of conduct, recruitment policies, employment policies and work environment have been regulated.
The laws relating to job-seekers are ones they must be well-aware of ahead of time. The lack of anti-discriminatory policies implies that employers have the right to make any demand from individuals belonging to different nations or ethnic groups. The absence of minimum wage results in remunerations being based mostly on the nationality of job-seekers. Frequent change in job is not a normal practice in Dubai and the employer normally holds the passport of the worker as a safeguard.
The law in Dubai even has clearly charted regulations regarding termination of employment. According to the law, a worker of a company must give a notice of a minimum of thirty days to the employer, if he or she wishes to terminate the job contract. The law is even very unambiguous about clearing the worker's dues, including unclaimed leaves and other benefits. One more advantage of the employment law in Dubai is that those workers who do not enroll in the pension scheme of the firm are to be paid gratuity after the termination of their employment. The law is so powerful in the state that just in case an employee does not receive all their dues, they can approach the Minister of Labour through a toll-free number.
The labour law in Dubai is quite strict about one thing, though, and that's the inflexibility regarding alterations on contract periods.
