Concerning the management of justice, the Holy Quran declares, Confidently We have revealed the Book to you with fact so that you may judge between persons by means of what Allah Almighty has trained you. And be not one beseeching the cause of the untruthful. The stanza put down that deceitfulness must be chastised, and the equilibrium of fairness must be held equivalent between groups and adversaries, Muslims and non-Muslims.
Judges are obligatory to be standing so as not to be persuaded by ties of association or by deliberations of terror, favor or the caring. The Holy Quran says that you who have faith in, be maintainers of fairness, carriers of testament for Allah Almighty, even though it be in contradiction of your own selves or (your) parentages or near families — whether one be ironic or poor. And then not let abhorrence of a people keep you from acting defensibly” So judge between men impartially and follow not wish.
The Prophet of Islam (Peace Be Upon Him) was recognized for his reasonable and neutral management of fairness. He severely applied equality before law, and never completed any difference between plaintiffs on the foundation of confidence or relatives. Instead of demanding any legal protection, he laid down the rule that even the leader of state may be dared, in both official and secluded capacities, in a court.
The replacements of the Prophet (Peace Be Upon him) also safeguarded the application of judicial individuality and neutrality. Caliph Umar once went to a judge for the resolution of a disagreement. The judge, on sighted the caliph, rose to his feet as a mark of admiration. Umar, seeing the performance as an unpardonable weakness, directly discharged him from office.
These examples show the extent to which impartiality is expected of a Muslim magistrate. The following share of a letter, inscribed by Ali to one of his councils, eloquently clarifies the rank and role of the bench in Islam,
“Choice as your chief magistrate one from the people who by far is the finest amongst them; one who is not worried with national misgivings; one who cannot be daunted; one who does not blunder too often; one who does not go back from the right trail once he finds it; one who is not self-centered or greedy; one who will not decide before knowing full facts; one who will consider with care every associated hesitation and speak a clear decision after taking the whole thing into full deliberation; one who will not produce restive over the influences of supporters; one who will inspect with endurance every new revelation of truths; one who will be severely neutral in his conclusion; one whom obsequiousness cannot misinform; one who does not revel over his location.
But it is not relaxed to discover such men. Once you have chosen the precise man for the office, pay him kindly enough to let him live in treat and in custody with his place, adequate to keep him above temptations. Give him a site in your law court so high that none can even dream of deficient it, and so high that neither infighting nor intrigue can drop him.
